St. Lawrence County Real Property Department Auction Terms & Conditions 1. THE PROPERTIES CONTAINED IN THIS BOOKLET ARE OFFERED FOR SALE TO THE HIGHEST BIDDER BY THE ST. LAWRENCE COUNTY TREASURER. SOME PARCELS LISTED IN THIS BOOK MAY BE SOLD PRIOR TO THE SALE, AND THEREFORE WILL NOT BE AVAILABLE FOR SALE ON THE AUCTION DAY.
2. THERE IS ABSOLUTELY NO REPRESENTATION AS TO THE QUALITY OF TITLE, LOT SIZE OR CONDITION OR EXISTENCE OF
IMPROVEMENTS OF ANY PARCEL TO BE AUCTIONED AND ALL PERSONS ARE AT THEIR OWN RISK WITH RESPECT TO THE SAME. BUILDINGS HAVE NOT BEEN INSPECTED FOR SUCH ITEMS AS LEAD PAINT OR ASBESTOS. THE COUNTY SELLS ONLY ITS LIEN AND INTEREST, AND WILL NOT CONVEY BY WARRANTY DEED, AND SHALL CONVEY BY QUIT CLAIM DEED ONLY. ALL BIDDERS ARE URGED TO CONSULT AN ATTORNEY BEFORE SUBMITTING A BID HEREIN.
3. ALL BIDDERS SHOULD BE REGISTERED AND HAVE A BIDDER NUMBER ASSIGNED TO THEM PRIOR TO THE COMMENCEMENT OF THE AUCTION.
4. THE HIGHEST BIDDER MUST SUBMIT 20% OF THE BID OR A $50 DEPOSIT, WHICHEVER IS GREATER, ON THE DAY OF THE AUCTION. ALL DEPOSITS ARE TO BE MADE BY CASH, CERTIFIED CHECK, MONEY ORDER, BANK CHECK OR PERSONAL CHECK. IF PAYING BY PERSONAL CHECK, A SEPARATE CHECK MUST BE SUBMITTED FOR EACH PARCEL PURCHASED. NO EXCEPTIONS.
5. BALANCE MUST BE PAID BY CASH, CERTIFIED CHECK OR BANK CHECK, (NO PERSONAL CHECKS), WITHIN THIRTY (30) DAYS OF THE AUCTION. FULL PAYMENT MUST BE RECEIVED WITHIN THIRTY (30) DAYS OR THE 20% OF THE TOTAL BID OR $50 WILL BE FORFEITED TO ST. LAWRENCE COUNTY. IN THE EVENT OF DEFAULT OF THE HIGH BIDDER, THE COUNTY RESERVES THE RIGHT TO ACCEPT THE SECOND HIGHEST BID.
6. IN ADDITION TO THE BID PRICE, THE BIDDER WILL HAVE TO PAY THE FOLLOWING FEES BEFORE THE COUNTY TREASURER WILL ISSUE A DEED:
A. $185 RECORDING FEE FOR ALL RESIDENTIAL (PROPERTY CLASS 200’S) AND AGRICULTURAL (PROPERTY CLASS 100’S).
B. $310 RECORDING FEE FOR ALL OTHERS (PROPERTY CLASS 300’S THRU 900’S).
THE COUNTY TREASURER WILL RECORD THE DEED AFTER THE FOLLOWING AMOUNTS ARE PAID:
1. A & B, MADE PAYABLE TO THE COUNTY CLERK.
2. BALANCE OF THE BID, MADE PAYABLE TO THE COUNTY TREASURER.
7. THE FIRST TAX OWED BY THE PURCHASER WILL BE THE JANUARY 2012 TAX BILL.
8. ALL REAL PROPERTY, INCLUDING ANY BUILDINGS THEREON, ARE SOLD “AS IS” AND WITHOUT ANY REPRESENTATION OR WARRANTY WHATSOEVER AS TO THE CONDITION OR TITLE, AND SUBJECT TO:
A. ANY STATE OF FACTS AN ACCURATE SURVEY OR PERSONAL INSPECTION OF THE PREMISES WOULD DISCLOSE;
B. APPLICABLE ZONING/LAND USE/BUILDING REGULATIONS;
C. FEDERAL AND/OR STATE TAXES, LIENS, JUDGEMENTS AND ENCUMBRANCES OF RECORD;
D. EASEMENTS, COVENANTS, CONDITIONS AND RIGHTS-OF-WAY OF RECORD EXISTING AT THE TIME OF THE LEVY OF THE TAX, THE NON-PAYMENT OF WHICH RESULTED IN THE FORECLOSURE IN WHICH ST. LAWRENCE COUNTY ACQUIRED TITLE.
9. CONVEYANCE SHALL BE BY QUIT CLAIM DEED ONLY, CONTAINING A DESCRIPTION OF THE PROPERTY AS IT APPEARED ON THE TAX ROLL FOR THE YEAR UPON WHICH THE COUNTY ACQUIRED TITLE.
10. NO PERSONAL PROPERTY IS INCLUDED IN THE SALE OF ANY OF THE PARCELS. THE DISPOSITION OF ANY PERSONAL PROPERTY LOCATED ON ANY PARCEL SOLD SHALL BE THE SOLE RESPONSIBILITY OF THE SUCCESSFUL BIDDER FOLLOWING THE CLOSING OF SALE.
11. ALL INFORMATIONAL TOOLS, SUCH AS SLIDES, TAX MAPS, DEEDS, PHOTOS, AUCTION LISTINGS, AUCTION CATALOGS, ETC., ARE FOR IDENTIFICATION PURPOSES ONLY AND ARE NEITHER A GUARANTEE NOR A WARRANTY AS TO LOCATION, DIMENSIONS, PARCEL USE/SIZE.
12. EVICTIONS, IF NECESSARY, ARE SOLELY THE RESPONSIBILITY OFTHE SUCCESSFUL BIDDER AFTER CLOSING AND RECORDING OF THE DEED.
13. THE PURCHASER MAY NOT ASSIGN HIS/HER RIGHT TO COMPLETE THE SALE. ALL DEEDS SHALL BE EXECUTED IN THE NAME OF THE BIDDER (S) AS REGISTERED AT THE AUCTION.
14. THE AUCTION WILL BE HELD IN THE LOCKWOOD ARENA, WEST RIVER STREET, OGDENSBURG, NY.
